A legal will in New Jersey provides for the distribution of your property at the time of your death. If you die intestate (without a will), New Jersey's intestacy laws will determine who receives your property. Broadly speaking, these laws represent the legislature's best guess as to how you would have liked to distribute your property. A will permits you to determine how you would like your property distributed. As New Jersey probate attorneys, we know that your will is one of your most important documents.

A will must follow certain legal formalities. If it is not drafted in compliance with these formalities, it will be declared invalid and your property will be distributed as if you had died intestate. Generally, a valid will must be signed by the person whose will it is (the "testator") and the signature must be witnessed by two persons. Although an intended beneficiary of the will is permitted in some states to witness the will, a better practice is to have two disinterested persons witness it.

In addition to providing for the disposition of your property, your will may also accomplish several other important objectives. Perhaps the most important is the provision for a guardian for any minor children. You may also provide for a trust and appointment of a trustee for each minor child's estate. In your will, you may also designate an executor who will act as your personal representative in carrying out the instructions of your will. You may also choose to provide for a person (such as a godchild, employee, or close friend) or even a cherished pet who would not otherwise receive a benefit from your estate. Further, a will allows you to choose as beneficiary's organizations which you might wish to support, such as churches, charities, and schools.

Everyone should have a will. Many people either do not want to face the implications of drafting a will or do not believe that they have enough "property" to warrant a will. But everyone has some property, whether it is a multi-million dollar New Jersey shore estate or something considerably smaller. A will ensures the orderly disposition of that property in accordance with your wishes.
